Fankooshi™ / Fankoushi™ Public Use Policy

1. Definition of Terms
For the purposes of this policy:
- “Fankooshi™ / Fankoushi™” refers collectively and interchangeably to the creative marks Fankooshi™ and Fankoushi™, including all spelling variants, capitalizations, stylizations, and phonetic equivalents.
- Any reference in this policy to “Fankooshi™” shall be deemed to include “Fankoushi™,” and vice versa.
- The terms are legally inseparable for purposes of ownership, permitted use, restrictions, licensing, and enforcement.
This definition applies throughout this document, whether one or both spellings are explicitly shown.
2. What Is Fankooshi™ / Fankoushi™?
Fankooshi™ / Fankoushi™ is an open creative challenge and experimental short-form format originated by Sammem Studio™, the creative arm of InformaServ® Inc.
The concept is intentionally undefined.
It may be humorous, mysterious, absurd, emotional, cinematic, abstract, or symbolic.
Creators are invited to interpret their own Fankooshi™ / Fankoushi™ through short-form video and creative media.
3. Ownership of the Marks
The names Fankooshi™ and Fankoushi™ are proprietary creative marks owned exclusively by InformaServ® Inc. and used commercially by Sammem Studio™.
Ownership of the marks is not transferred or shared by virtue of participation, usage, or publication of content.
This policy serves as public notice of ownership and permitted use.
4. Permitted Open Creative Use
Subject to this policy, you may:
- Create and publish original content interpreting Fankooshi™ / Fankoushi™
- Post such content on TikTok, YouTube, Instagram, or similar platforms
- Remix, parody, abstract, or creatively reinterpret the concept
- Monetize your individual content through platform-native monetization features
- Use hashtags such as #Fankooshi, #Fankoushi, and #FankooshiChallenge
No prior permission is required for these uses.
5. Prohibited Uses Without Authorization
The following uses are strictly prohibited without prior written authorization from InformaServ® Inc., regardless of spelling:
- Selling or marketing courses, workshops, or training programs branded as Fankooshi™ / Fankoushi™
- Offering paid services, consulting, or coaching under the Fankooshi™ / Fankoushi™ name
- Selling merchandise bearing the Fankooshi™ / Fankoushi™ name or likeness
- Registering businesses, domains, or social accounts implying official ownership
- Claiming authorship, ownership, or official endorsement of the project
- Using either spelling in a manner likely to cause confusion as to origin or affiliation
Commercial or institutional use requires explicit licensing.
6. Content Rights & License Grant
Fankooshi™ and its alternative forms are IP of InformaServ Inc.® and Sammem Studio™. By publishing content using Fankooshi™ #Fankooshi, #Fankoushi, or any related official hashtag, you agree that:
- You retain full ownership of your original content.
- You grant Sammem Studio™ / InformaServ® Inc. a non-exclusive, worldwide, perpetual, royalty-free license to:
- repost, feature, or curate the content
- include the content in compilations, showcases, archives, or reels
- reference the content in promotional or educational materials
- display the content as part of the Fankooshi™ / Fankoushi™ project ecosystem
This license applies equally to content tagged with either spelling.
7. Attribution & Community Conduct
Where reasonably possible, creators are encouraged to attribute:
“Fankooshi™ / Fankoushi™ — a Sammem Studio™ project.”
Participants are expected to comply with platform rules and to avoid content that is unlawful, deceptive, or harmful.
8. Enforcement
InformaServ® Inc. and Sammem Studio™ reserve the right to:
- Request removal of content that violates this policy
- Issue takedown notices for misuse of the marks
- Enforce trademark and unfair competition rights
- Act against attempts to exploit spelling variations to bypass protections
Common-law trademark rights apply regardless of registration status.
9. Future Development
Fankooshi™ / Fankoushi™ may evolve into educational programs, curated collections, exhibitions, or other creative initiatives.
Participation does not grant any rights to future commercial uses.
